These Terms of Service ("Terms") govern your access to and use of the ProbableMind website at probablemind.com and the related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian who agrees to be bound by these Terms on your behalf.
2. Your account
You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us promptly at security@probablemind.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used to harm others.
3. Acceptable use
You agree not to:
- Use the Service to violate any law or third-party right.
- Submit content that is unlawful, defamatory, harassing, deceptive, or that infringes intellectual-property or privacy rights.
- Attempt to probe, scan, or test the vulnerability of the Service, or breach security or authentication measures.
- Interfere with or disrupt the Service, including by sending excessive or automated requests, scraping at scale, or attempting to overload our infrastructure.
- Reverse-engineer the Service or any underlying models, except to the extent that this restriction is prohibited by applicable law.
- Use the Service to generate or distribute misinformation, fraudulent content, or content that could cause real-world harm.
4. Your content
You retain ownership of the questions, hypotheses, evidence, and maps you create ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process Your Content solely so that we can operate and improve the Service. If you choose to publish a map publicly, you also grant other users a license to view and reference it within the Service.
You are responsible for Your Content and represent that you have the rights necessary to share it on the Service.
5. AI-generated output
The Service uses large language models and probabilistic reasoning to generate hypotheses, search queries, and posterior estimates. Output may be incorrect, incomplete, or inconsistent and should not be relied on as professional, legal, financial, medical, or investment advice. You are solely responsible for any decisions you make based on output from the Service.
6. Subscriptions and billing
Some features require a paid subscription. Fees, billing intervals, and the scope of paid features are described on our pricing page. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. Except where required by law, payments are non-refundable. We may change prices on notice; changes apply to the next billing cycle.
7. Trials, promotions, and beta features
We may offer free trials, promotional pricing, or features marked "beta". These are provided as-is and may be modified or discontinued at any time.
8. Intellectual property
The Service, including its software, design, and trademarks, is owned by ProbableMind and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.
9. Termination
You may stop using the Service at any time and may delete your account from your profile settings. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision of the Service to you becomes commercially impracticable. On termination, the licenses you grant us with respect to public content remain in effect for copies that were already shared.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUT WILL BE ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBABLEMIND AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY (OR US$100, WHICHEVER IS GREATER). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless ProbableMind from any third-party claim arising out of (a) Your Content, (b) your use of the Service in violation of these Terms, or (c) your violation of any law or third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. If you are a consumer in a jurisdiction that grants you mandatory rights to bring claims in your local courts, nothing in this section overrides those rights.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will notify you before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
